CONSTITUTION OF THE FEDERATIVE REPUBLIC OF BRAZIL The Constitution of the Federative Republic of Brazil is the supreme law of the Brazilian legal system. Promulgated on October 5, 1988, during the country’s transition to democracy, it establishes Brazil as a democratic federal republic founded upon principles including sovereignty, citizenship, human dignity, the social values of labor and free enterprise, and political pluralism. The Constitution guarantees an extensive framework of fundamental rights and protections, encompassing individual and collective rights, social rights, nationality, political rights, and political parties. It provides constitutional safeguards for equality, liberty, property, due process, education, health, labor, social security, and social assistance. The text organizes the Brazilian federation through the Union, the States, the Federal District, and the Municipalities, defining their respective powers and responsibilities. It also regulates the Legislative, Executive, and Judiciary branches, together with institutions essential to the administration of justice, including the Public Prosecution Service and the Public Defender’s Office. The Constitution further addresses taxation and public finances, the economic and financial order, the social order, national defense and democratic institutions, environmental protection, education, culture, family relations, and the rights of Indigenous peoples. Its amendment procedure allows constitutional development while protecting fundamental principles through substantive limitations on the power of constitutional reform.
